The short answer

To apply for maternity leave in California, you make two kinds of requests. First, tell your employer in writing, at least 30 days ahead when you can, that you need pregnancy disability leave (PDL) and, if you qualify, CFRA bonding leave after it. Your employer may ask for a provider’s certification without your diagnosis. Second, file your own claims with EDD: State Disability Insurance (SDI), then Paid Family Leave (PFL).

Applying for maternity leave in California happens on two tracks

There is no single application. You need both of these tracks.

TrackWhat it gives youWhere you apply
LeaveJob-protected time off: PDL, then CFRA bonding leaveYour employer
PayPartial wage replacement: SDI, then PFLThe Employment Development Department (EDD)

You file your own EDD claims, and asking your employer for leave does not start them. EDD also says PFL “provides benefit payments but not job protection.” Your right to come back comes from the leave laws.

Who qualifies? PDL covers employers with 5 or more employees and public employers, with no minimum time on the job. CFRA bonding leave covers the same employers if you have worked there more than 12 months and at least 1,250 hours in the past year. If your employer is very small, read maternity leave at a small employer. To map your weeks and pay, try the maternity leave planner or read is maternity leave paid.

When to tell your employer you need maternity leave

The notice rules are practical. Here is what California’s regulations say.

Planned

30 days ahead when you can

When the need is foreseeable, like a planned start before your due date, give at least 30 days’ notice.

Sudden

As soon as practicable

If 30 days isn’t possible, such as an early start or a medical emergency, tell your employer as soon as you can. Your employer can’t deny PDL or CFRA leave in an emergency just because notice came late, as long as you told it as soon as you could.

How

Spoken or written both count

Notice can be oral or written. For bonding leave, the rules say you don’t even need to mention CFRA, though you do need to give the reason. Put it in writing anyway, to create a record.

Response

Your employer has to answer

For PDL, your employer must respond within 10 calendar days of your request. For CFRA, within 5 business days.

What your provider’s certification needs to say

For PDL, your employer may require a written certification from your health care provider. It can be short. Under the regulations, a certification is enough if it states:

  • that you need to take pregnancy disability leave because you are disabled by pregnancy, and
  • the date you became disabled by pregnancy and the estimated length of the leave.

Your provider may not share your diagnosis without your consent, and your employer may not ask for more information than the rules allow.

When it is due

If you gave 30 days’ notice of a planned leave, provide the certification before the leave begins. Otherwise, your employer must give you at least 15 calendar days after it asks.

Bonding leave needs no medical note

CRD’s leave guide lists medical certification as not applicable to CFRA bonding leave.

Starting January 1, 2027: no doctor’s fee for EDD certificates

Under AB 2292, a physician or practitioner may not charge an administrative fee to complete the medical certificate for an SDI or PFL claim. They can still bill for an exam or care.

How to apply for maternity leave, step by step

Follow these in order. The letters are starting points; change the details to fit your situation.

  1. Check which leave you qualify for

Confirm your employer’s size and your time on the job (see above). The leave planner lays out your dates, and PDL, CFRA and FMLA explains how the laws overlap.

  2. Send your written leave request

Send it to your manager and HR at least 30 days before your expected start date when you can. Ask for both leaves in one letter, and ask for the written promise of reinstatement the rules give you.

Copy this maternity leave request letter
Subject: Request for pregnancy disability leave and CFRA bonding leave

    Dear [manager or HR contact],

I am requesting leave for my pregnancy and the birth of my child. My expected due date is [date].

    1. Pregnancy disability leave (PDL). My health care provider expects that I will be disabled by pregnancy starting on or about [date]. I request PDL from that date for as long as my provider certifies, up to four months. I will provide my provider’s certification [now / by (date)]. It will state that I am disabled by pregnancy, the start date, and the estimated length of my leave.

    2. CFRA bonding leave. When my PDL ends, I request CFRA leave to bond with my baby for [number] weeks, through about [date].

    Please confirm in writing:
    - that my leave is approved, and the dates;
    - that I will return to my same position after PDL, and to my same or a comparable position after CFRA leave;
    - that my group health coverage will continue during my leave; and
    - your policy on using sick leave, vacation or other paid time off during each leave.

I understand a response is due within 10 calendar days for PDL and 5 business days for CFRA leave. If my dates change, I will let you know as soon as I can.

    Thank you,
    [Your name]
    [Job title]
    [Phone and email]
    [Date]
  3. Give your employer the certification

Ask your provider for a short note that says you are disabled by pregnancy, the start date and the expected length. If your employer asks for your diagnosis, you can politely point out that the rules don’t require it.

  4. Get the approval in writing

If you hear nothing, follow up in writing. A short, polite reminder creates a record. If your request is denied or you are punished for asking, read about pregnancy retaliation.

    Copy this follow-up email
Subject: Following up on my leave request of [date]

    Hi [Name],

On [date], I requested pregnancy disability leave starting on or about [date], and CFRA bonding leave after it. I have not yet received a response.

Please confirm in writing that my leave is approved, my dates, and that I will return to my same position after PDL [and to my same or a comparable position after CFRA leave].

    Thank you,
    [Your name]
  5. File your SDI claim with EDD

EDD says to apply when your provider says you can’t work and you begin losing wages, typically about 4 weeks before your due date, or earlier if your provider certifies complications. Register with myEDD and file in SDI Online, or mail the Claim for Disability Insurance (DI) Benefits (DE 2501).

File no earlier than 9 days and no later than 49 days after your disability begins. Your provider certifies your disability to EDD. The first 7 days of a new claim are an unpaid waiting period.

  6. Move to Paid Family Leave for bonding

When your disability claim ends, EDD sends you the Claim for Paid Family Leave (PFL) Benefits – New Mother (DE 2501FP), in your SDI Online Message Center or by mail. PFL pays up to 8 weeks in a 12-month period, used within 12 months of the birth.

Apply no earlier than the first day your family leave begins and no later than 41 days after. A parent without a pregnancy disability claim, such as a father or adoptive parent, sends a proof-of-relationship document, such as the child’s birth certificate.

  7. Tell your employer if your dates change

If your start or return date moves, tell your employer in writing as soon as you know. When your return date changes, your employer must reinstate you within 2 business days of your notice where feasible. More in getting your job back after maternity leave.

    Copy this date-change email
Subject: Update to my leave dates

    Hi [Name],

My [leave start date / return date] has changed from [old date] to [new date] because [my baby arrived early / my provider extended my leave / my provider released me to return].

[If returning:] I am ready to return to work on [date]. Please confirm my return date, position, schedule and pay in writing.

I will send any updated certification you need.

    Thank you,
    [Your name]

How to apply for maternity leave: common questions

How far in advance do I need to request maternity leave in California?

Give at least 30 days’ notice when the need is foreseeable, such as a planned start date before your due date. If that isn’t possible, give notice as soon as practicable. An employer can’t deny PDL or CFRA leave in an emergency just because you couldn’t give advance notice.

Do I have to tell my employer my diagnosis?

No. Your employer may require a certification from your provider, but it only needs to say that you are disabled by pregnancy, when that began, and how long the leave is expected to last. Your provider may not share your diagnosis without your consent.

Does my employer apply for SDI or PFL for me?

No. You file your own claims with EDD, online through myEDD and SDI Online or by mail. Your provider certifies the disability part. Asking your employer for leave and filing EDD claims are separate steps, and you need to do both on your own timeline.

Can I apply for maternity leave if I just started my job?

Yes, for PDL. There is no minimum time on the job, as long as your employer has 5 or more employees or is a public employer. CFRA bonding leave needs more than 12 months with the employer and 1,250 hours. You may still get SDI and PFL pay if you have paid into SDI.

What if my employer says no?

At an employer with 5 or more employees, or a public employer, it is unlawful to deny or interfere with your PDL rights, and the same goes for CFRA leave if you are eligible. Ask for the reason in writing, keep copies, and talk with a lawyer in a free virtual consultation.
